Terms, in plain words.
Flieder depends on accurate, authorized, and respectful memorial stewardship. These are the rules of the room — written plainly, but they are a binding agreement, so please read them.

Agreement to these terms
These Terms of Service are a binding agreement between you and Flieder (“Flieder,” “we,” “us”). By creating an account, creating or claiming a memorial, contributing content, or otherwise using flieder.life, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Flieder. If you use Flieder on behalf of a family or organization, you represent that you are authorized to accept these terms for them.
Who may use Flieder
You must be at least 16 years old to use Flieder, and at least 18 (or the age of majority where you live) to purchase a paid plan or enter a binding contract. Flieder is not directed to children. You are responsible for your account and for keeping your login secure; notify us at support@flieder.life if you suspect unauthorized access.
Respectful, authorized use
Use Flieder to create, manage, claim, or contribute to memorials in a respectful, truthful, and authorized way. Do not impersonate family members or the deceased, submit false claims, publish private or invasive details about living people without a lawful basis, harass contributors, infringe anyone’s rights, or use memorials or the archive for scams, advertising, or unauthorized commerce. You agree to comply with all applicable laws.
Family control
Memorial owners and approved family managers control visibility, search indexing, tribute settings, photo contributions, location display, QR sharing, and publication. These controls exist to honor the family’s wishes. Creating a memorial does not transfer ownership of anyone’s likeness, name, or copyrighted works to Flieder or to other users.
Your content and the license you grant us
You keep ownership of the names, stories, photographs, and other content you submit (“Your Content”). To operate the service, you grant Flieder a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (e.g., resize images), and display Your Content solely to provide and improve Flieder, consistent with the privacy settings you choose. You represent and warrant that you have all rights and permissions needed to submit Your Content and to grant this license, and that Your Content does not violate any law or third-party right (including copyright, privacy, and publicity rights). This license ends when the content is deleted, except for residual backup copies kept for a limited time.
Contributions, claims, and disputes
Contributors are responsible for the stories, photos, names, emails, links, and relationship details they submit, and must only upload content they have the right to share. Claim and verification requests must be honest and supported by appropriate evidence. Families and moderators may approve, edit, reject, lock, transfer, correct, or remove memorials, claims, or contributions that are inaccurate, unauthorized, harmful, infringing, invasive, commercial, or inconsistent with privacy controls. We may resolve ownership disputes in the way we reasonably believe best protects the family and the accuracy of the record.
User content is not ours, and we do not verify it
Memorials, tributes, and archive entries are created by users, not by Flieder. We do not author, endorse, or independently verify user content, and we are not responsible for its accuracy or for content posted by others. We are not obligated to monitor content, but we may review and remove it at our discretion. If you believe content is inaccurate, unauthorized, infringing, or harmful, report it to support@flieder.life so we can review it.
Copyright and takedown
We respect intellectual-property rights. If you believe content on Flieder infringes your copyright, email support@flieder.life with: the work you claim is infringed, the URL of the material, your contact information, a statement that you have a good-faith belief the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorized to act for them, and your signature. We will remove or disable infringing material in appropriate cases and may terminate repeat infringers.
Plans, payments, and cancellation
Free memorials are real memorials. Paid plans unlock additional features (such as public, search-visible publishing and the full set of environments). Payments are processed by Stripe; we never store full card details. Annual plans renew automatically until cancelled — you can cancel any time from your account, and cancellation stops future renewals (it does not retroactively refund the current term). Lifetime is a one-time payment for the features described at purchase, for as long as Flieder operates the service (see below). Prices may change prospectively; changes never affect a purchase you have already made. Except where required by law, payments are non-refundable; if you believe you were charged in error, contact support@flieder.life.
Availability and “kept forever”
We work hard to keep memorials safe and available and design the product so a lapsed payment never deletes a memorial. “Kept forever” and “lifetime” describe our intent and the absence of recurring billing — they are not a guarantee that the service will operate indefinitely. We may modify, suspend, or discontinue features or the service. If we ever plan to discontinue Flieder, we will use commercially reasonable efforts to give advance notice and a way to export or retrieve your content.
Service provided “as is”
Flieder is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that content will always be preserved or accurate. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Flieder and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or emotional distress, arising from or related to your use of (or inability to use) Flieder or any user content. Our total liability for all claims relating to the service will not exceed the greater of the amount you paid Flieder in the 12 months before the claim or US $100. These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Flieder and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of Flieder, your violation of these terms, or your violation of any law or third-party right.
Disputes — arbitration and class-action waiver
Please read this carefully — it affects how disputes are resolved. You and Flieder agree that any dispute arising out of or relating to Flieder or these terms will be resolved by binding individual arbitration administered under the rules of a recognized US arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property or unauthorized-access matters. You and Flieder waive any right to a jury trial and agree that claims may be brought only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative action. You may opt out of this arbitration agreement by emailing support@flieder.life within 30 days of first accepting these terms; opting out does not affect the other terms. If the class-action waiver is found unenforceable, the entire arbitration section will not apply.
Governing law
These terms and any dispute are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in Delaware will have jurisdiction, and you consent to venue there. Nothing in these terms limits consumer-protection rights that cannot be waived under the law of your place of residence.
Suspension, termination, and changes
You may stop using Flieder at any time and may request deletion of your account. We may suspend or terminate access that violates these terms, is abusive, infringing, fraudulent, invasive, or unlawful, or that creates risk for the families we serve. We may update these terms; if changes are material, we will surface notice before they take effect, and continued use after that means you accept the updated terms.
